1. Who We Are and Scope

LIOFANT is a brand operated by Bullseye Viksitra India Private Limited ("LIOFANT", "we", "us" or "our"). This Cookie Policy explains how cookies and similar technologies may be used when you visit www.liofant.com, sign in, add products to a cart, place an order, submit an enquiry or otherwise interact with our online store.

This Cookie Policy forms part of and should be read with the LIOFANT Privacy Policy and Terms & Conditions. If information collected through cookies or similar technologies identifies or relates to an identifiable individual, we handle that information in accordance with the Privacy Policy and applicable law.

2. What Cookies and Similar Technologies Are

A cookie is a small text file or identifier that a website or service may store on your browser or device. Cookies can help maintain a secure session, remember a shopping cart or preference, understand how pages are used, measure a campaign and support other website functions. Similar technologies can include local storage, pixels, tags, SDKs or comparable device/browser identifiers where those technologies are enabled.

Zoho Commerce states that its store statistics may use user-agent, device and IP-location information and that, instead of storing the IP address for those statistics, the country is inferred from it and stored. Other enabled service providers may process technical information under their own documented practices and our applicable agreements with them.


3. Categories of Cookies We May Use

 5. Third-Party Services and Integrations

The store is hosted/operated using Zoho Commerce and may use payment gateways, communications tools, analytics providers, customer-support services, social-media features, embedded content, campaign tools, logistics services or other integrations. A third party may set or read its own cookie or similar identifier when its service is used, particularly when you leave LIOFANT for a payment or external service page or interact with embedded content.

Third-party cookies and processing are also governed by the relevant provider's privacy/cookie terms. LIOFANT does not control an independent third party's website or technology merely because it is linked or integrated. This allocation of responsibility does not remove any legal duty that applicable law places on LIOFANT for its own selection, configuration, instructions, conduct or processing.

6. Your Cookie Choices and Consent

Where applicable law requires a choice for non-essential cookies or cookie-based personal-data processing, LIOFANT will provide or support a clear mechanism to make that choice. Consent, where it is the applicable basis, should be free, specific, informed and unambiguous and capable of being withdrawn through a reasonably accessible method. Merely continuing to browse will not be treated as a substitute for affirmative consent where the law requires clear affirmative action.

Necessary security, session, cart and transaction technologies may remain active where they are required to provide a service you request, protect the store, maintain a session, prevent fraud or meet another lawful requirement. Rejecting or disabling such technologies may mean that sign-in, cart, checkout or other store functions do not work properly.

You can also control or delete cookies using your browser/device settings. Removing cookies may reset saved preferences or require you to sign in again. Browser controls do not necessarily disable every form of local storage, server-side processing or technology used by a third-party page that you independently visit.

7. Cookie Retention and Data Retention

A cookie may be a session cookie that expires when the session/browser ends or a persistent cookie that remains for a defined period. Indicative Zoho Commerce cookie validity is shown above. Information derived from a cookie may be retained separately from the browser cookie for a different lawful period needed for analytics, security, fraud prevention, customer service, accounting, disputes or legal compliance, as described in the Privacy Policy.

8. Security, Cyber Incidents and Technology Failures

We use reasonable administrative, technical and organisational safeguards appropriate to the nature of the information and our business. No internet-facing system, cookie, browser, cloud platform, payment environment or transmission method can be guaranteed absolutely secure. If we become aware of a cyber-security or personal-data incident, we may contain, investigate and remediate it, preserve relevant records, restrict affected functions, work with technology/payment providers and make reports or notifications required by the law then in force and applicable to LIOFANT.

To the fullest extent permitted by law, LIOFANT and the Protected Parties defined in our Terms & Conditions are not contractually responsible for delay, temporary unavailability or loss caused solely by a sophisticated third-party attack, malware, ransomware, denial-of-service attack, zero-day exploitation, widespread telecommunications/internet/DNS/cloud/data-centre/payment outage or other event beyond reasonable control where legally required safeguards were maintained and reasonable mitigation steps were taken. This protection does not exclude any statutory privacy, data-security, consumer or incident-reporting duty that law does not permit us to exclude.

9. User Responsibility, Indemnity and Protection of LIOFANT Parties

For these policies and the LIOFANT Terms & Conditions, "Protected Parties" means Bullseye Viksitra India Private Limited; LIOFANT; every other brand owned, licensed or lawfully operated by the Company; its past, present and future holding, subsidiary, affiliate or group entities (where applicable); and their respective founders, promoters, shareholders (in that capacity), directors, key managerial personnel, officers, employees, authorised representatives, agents, professional advisers, contractors, successors and permitted assigns. Relevant licensors, technology and cloud providers, payment providers, suppliers, manufacturers, warehouses, carriers and logistics partners are also Protected Parties only to the extent a claim against them arises from or is materially connected with a user's breach, misuse, unlawful conduct or the LIOFANT transaction concerned.

The indemnity in the LIOFANT Terms & Conditions is incorporated into this Cookie Policy. Without limiting it, to the fullest extent permitted by law you agree to indemnify the Protected Parties against third-party claims, direct losses and reasonable legal or professional costs to the extent caused by your tampering with cookies, identifiers, consent controls, cart/session state or security features; malware, automated abuse, credential sharing, impersonation or attempted unauthorised access; unlawful scraping or use of cookie/session data; or the unauthorised provision, upload or disclosure of another person's data.

This indemnity applies only to the extent the claim or loss is attributable to you or a person/system for which you are legally responsible. It does not transfer to you any statutory privacy, cookie/consent, security or breach-response duty that applicable law requires LIOFANT itself to bear. Consumer liability remains subject to non-waivable rights and proportionality; business-user indemnities survive account closure and termination for earlier events.

To the fullest extent permitted by law, an ordinary contractual claim arising solely from a LIOFANT website transaction or Company obligation shall be pursued against Bullseye Viksitra India Private Limited and not personally against a founder, promoter, shareholder, director, officer, employee or representative merely because of that person's office, status or relationship with the Company. This does not protect any person from liability that applicable law imposes personally for that person's own fraud, wilful misconduct or other conduct that cannot lawfully be excluded.

10. Force Majeure

A "Force Majeure Event" under this Cookie Policy includes any qualifying event defined in the LIOFANT Terms & Conditions, including natural disaster, war/civil disruption, governmental or regulatory restriction, material power/telecommunications/internet/DNS/cloud/data-centre failure, e-commerce/payment-platform outage, or sophisticated ransomware, denial-of-service, zero-day exploitation, third-party service-provider compromise or other cyber incident beyond LIOFANT's reasonable control that could not reasonably have been prevented by legally required safeguards.

To the fullest extent permitted by law, neither LIOFANT nor a Protected Party is in breach or contractually liable for delay, temporary unavailability or loss caused solely by a Force Majeure Event. LIOFANT may suspend or restrict affected website, cookie/consent, cart, checkout, account or support functions; isolate systems; change a technology/provider route; or take reasonable containment and continuity measures while the disruption continues.

Force majeure does not waive a mandatory privacy, cookie/consent, security, incident-reporting, consumer or regulatory obligation that applicable law requires LIOFANT to perform, and it does not exclude liability that cannot lawfully be excluded. LIOFANT will take commercially reasonable steps to mitigate material disruption.

11. Changes to This Cookie Policy

We may update this Cookie Policy when our store features, cookies, integrations, service providers or legal obligations change. The current version will be posted on www.liofant.com with the revised date. Where applicable law requires additional notice or fresh consent for a material new purpose, we will provide it.

12. Questions, Choices and Grievances

Privacy and consumer grievances will be handled within the period required by the law in force and applicable to the request.

13. Governing Law, Mediation, Arbitration and Jurisdiction

These policies, the Terms and any transaction with LIOFANT are governed by the laws of India, without prejudice to any mandatory law that applies to a consumer or transaction.

Good-faith resolution. Before commencing contractual proceedings, a party should send a written Dispute Notice describing the dispute and relief sought to the other party (a notice to LIOFANT may be sent to the Grievance Officer/contact details stated below). Senior or authorised representatives will attempt in good faith to resolve the dispute for 15 business days after receipt. This step does not prevent urgent interim relief, a statutory complaint, recovery action expressly preserved by law, or a filing reasonably necessary to preserve limitation.

Mediation. If a business/commercial dispute is not resolved by negotiation, the parties shall attempt confidential mediation in Bengaluru, Karnataka, before arbitration. The mediator will be independent and mutually agreed within 10 business days; if no mediator is agreed within that period, or mediation does not settle the dispute within 30 calendar days after appointment (unless extended by written agreement), the mediation step is deemed exhausted. Mediation may be conducted physically, online or in hybrid form. The Mediation Act, 2023 will apply only to the extent its relevant provisions have been brought into force and are applicable at that time; otherwise the parties may follow mutually agreed institutional or mediator procedures. No party is required to accept a settlement.

B2B arbitration. Any dispute arising out of or relating to these policies, the Terms, a website transaction, quotation or order that is not settled through the process above and is legally capable of arbitration shall, where the purchaser acts wholly for business or commercial purposes, be finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, as amended. The arbitration will be administered by the Arbitration & Conciliation Centre - Bengaluru (Domestic & International), an initiative of the High Court of Karnataka, under its rules then in force, by a sole arbitrator appointed in accordance with those rules. The juridical seat and legal place of arbitration shall be Bengaluru, Karnataka; the language shall be English. Hearings may be conducted online or at another convenient venue without changing the Bengaluru seat. If the Centre is unavailable or declines administration, the arbitration shall proceed before a sole independent arbitrator jointly agreed by the parties, failing which appointment may be sought under section 11 of the 1996 Act. LIOFANT will not have a unilateral right to appoint the sole arbitrator.

Interim relief, confidentiality and costs. A party may seek interim, conservatory or protective relief from a competent court or arbitral tribunal, including under sections 9 and 17 of the Arbitration and Conciliation Act, 1996, without waiving arbitration. Mediation and arbitration will be kept confidential to the extent required by applicable law and the applicable rules, subject to disclosures needed for professional advice, regulatory compliance, enforcement or challenge. Arbitration costs will be determined in accordance with applicable law and the institutional rules; no pre-dispute term requires one party to bear all arbitration costs regardless of outcome.

Consumers and mandatory statutory forums. Nothing in this dispute clause restricts a consumer from approaching a Consumer Commission, the National Consumer Helpline or any other statutory authority/forum having jurisdiction, nor does it compel a consumer to arbitrate where applicable law leaves that choice to the consumer. If a consumer elects arbitration after a dispute has arisen, the Bengaluru arbitration framework above may be used to the extent lawful and agreed. Nothing here limits any mandatory right or forum available to LIOFANT or a qualifying supplier under the Micro, Small and Medium Enterprises Development Act, 2006, or any other overriding statutory mechanism.

Jurisdiction. For proceedings arising from an arbitration seated in Bengaluru, the courts at Bengaluru, Karnataka having supervisory jurisdiction under the Arbitration and Conciliation Act, 1996 shall have exclusive jurisdiction. For non-arbitrable non-consumer court disputes, the competent courts at Bengaluru shall have exclusive jurisdiction to the extent the parties may lawfully agree and those courts otherwise have jurisdiction. Statutory consumer, regulatory, cyber/data-protection, criminal and other non-waivable jurisdiction rules remain unaffected.
